We prepared the documents for the trial by declaration as per our Terms and Conditions (user agreement) that every client must agree to prior to completing our online sign up process. We emailed the final documents for the trial by written declaration to the client. We delivered the service the client signed up for as promised. So calling our service is scam is a far stretch.

We did not hear any complaints or any issues with the documents that we had prepared for the client until we had a chargeback with paypal filed by the client. According to the chargeback statement filed by the client on Paypal, the client indicated that the item was not received. That was an absolutely false statement. We provided paypal with proof of delivery.

The service we provide is clearly described in our "How it Works" page which is accessible from the top navigation bar on all the website pages. The service we provide is consistent with the description on that page. We assist people in preparing their legal documents based on information provided to us by the client since we were not present during the time of the alleged violation and when the citation was issued. Therefore, we rely on the client to send us the information. Furthermore, we cannot change the facts of the situation or come up with alternative facts.

We provided the client with the service as clearly described in our user agreement "Explanation of service". (See relevant section below). The service we provide is also clearly described in our "How it Works" page which is accessible from the top navigation bar on all the website pages. We are Legal Document Assistant and the service we provide is consistent with that. We assist people in preparing their legal documents based on information provided to us by the client (see user agreement) since we were not present during the time of the alleged violation and when the citation was issued. Therefore, we rely on the client to send us the information. Furthermore, we cannot change the facts of the situation or come up with alternative facts.

Also, the client indicated to us by email that he did not have the funds to post the $500 bail required by the court, therefore he could not use the documents that we had prepared for him. That was his reason for asking us to refund our fee despite the facts that we had spent the time and the effort to prepare all the documents for the client. It is important to note that we do not make the court rules such as posting the full bail amount when contesting a ticket with a trial by written declaration. We just follow the court rules.

On our website, we clearly explain that the courts require for the bail to be posted at the time of filing the trial by written declaration documents. This is a requirement by the courts. As indicated before, we do not make the court rules we just follow them.

At any rate, we issued a full refund to this client even though we did deliver the service as promised.

Explanation of service:
Purchase and the payment of our fees for the preparation of the trial by written declaration we will prepare and provide you with all the completed documents for you to file a trial by written declaration with the court, according to your choice of delivery, in a timely manner. All statements and documents are prepared by us based on information provided to us by you in accordance to your direction

We provide service to hundreds of people every month. While majority of these tickets that we work on are dismissed, unfortunately despite our efforts it is impossible to succeed every time. Also, it is important to note that we do not claim in any shape or form that all tickets would be dismissed. However, we do offer a 100% money back guarantee of our low $99 service fee if a ticket is not dismissed in the trial by written declaration.

We do not have any unreasonable requirements to honor our 100% money back guarantee offer. We just have one simple requirement to issue the refund; We require that the client send us a copy of the court verdict (form TR-215) within 30 days of the date on the court verdict. That’s all. Once we verify the guilty verdict we issue the refund. It is that simple. 30 days is very generous and certainly it provides the client with ample time to email, fax or mail a copy of the letter to us. We do not think it is unreasonable for us to want to verify the verdict to make sure it was a guilty verdict before we issue the refund.

In this case the verdict was dated September 23,2016. However, we did not get the verdict emailed to us until November 15,2016. That is well over the 30-day requirement. When making a refund guarantee claim; you must submit a copy of the Notice of Decision, form TR-215, within 30 days of the date on the notice of decision, showing you were found guilty of the violation and/or the violation or the fine was not dismissed. It may take the Company a minimum of 5 business days to process the refund to your credit card.

On August 29,2015, Lashunda M. Signed up for our service to prepare her trial by written declaration documents on 24-hour Rush basis to fight a traffic ticket. We prepared the documents for the trial by declaration as per our user agreement. We sent the final documents for the trial by written declaration to the client in a timely manner.

Then, we received an email from the client indicating that she had set up a court date instead of a trial by written declaration and she was asking for a refund despite the fact that we had completed all the work and spent the time to prepare her trial by written declaration for her.

Please refer to our cancellation policy clearly indicated in our Terms and Conditions.

“Cancellation of Service:
If you decide to cancel the service to prepare your documents for trial by written declaration, you must inform the company by email immediately and prior to receiving the completed documents from the company. After the Company has prepared and sent you your completed documents for a trial by written declaration if you are unable to or decide not to file the documents prepared by the company for trial by written declaration with the court for any reason, the Company shall not refund the service fee to you.”

The service we provide is preparing trial by written declaration documents at the client’s specific directions and after we prepare and deliver the documents to our clients we cannot take it back. The reason for this is very simple, everyone can sign up for our service and after receiving the documents they can just cancel the service, ask for a refund and keep the documents that we prepared for them. We do not sell merchandise that we can tell the client to send the merchandise back for a refund.

In this case we prepared the documents and delivered it in a timely manner to the client.
